During my 18+ year career as a REALTOR® in Sacramento, I have completed numerous transactions involving Probate and Trusts. Along with my practical transaction experience, I have earned the Certified Probate Real Estate Specialist (CPRES) designation from US Probate Services, as well as the Probate & Trust Specialist certification from the California Association of REALTORS®. In addition to helping numerous clients sell property via Probate or a Trust, I also was named as the “personal representative” and administrator of my own mother's estate when she passed away, and have experienced the other side of the process as well. What's a Probate or Trust Sale?
In a nutshell a Probate Sale is the court-supervised process by which an estate sells a piece of real estate that was owned by someone who passed away without a Trust and/or Will. The court appoints a “personal representative” to oversee the distribution of estate assets. A Trust Sale may involve selling the real estate owned by someone living or deceased. A Trust is essentially a private estate planning contract; a legal document that establishes and oversees the transfer of your assets after your death. Typically after a “trustee”' dies, there is a “successor trustee” who is pre-designated to oversee the distribution of trust assets. These Probate and Trust real estate transactions are highly nuanced, require additional steps, different disclosures than a traditional sale, extra paperwork, and really should be handled by a real estate professional with special expertise in these areas.
